Terms and Conditions for The Next Tick Algo Systems

Welcome to The Next Tick Algo Systems . These Terms and Conditions (“Terms”) govern your use of our website, the purchase and use of our trading algorithms, enrollment in our educational courses, and participation in our partnership program. By accessing our website or purchasing our products, you agree to be bound by these Terms.

1. Scope of Agreement and Eligibility

These Terms constitute a legal binding agreement between you (“User,” “Client,” or “Partner”) and The Next Tick Algo Systems (“Company,” “we,” or “us”). By using our services, you represent that you are at least 18 years of age and possess the legal capacity to enter into this agreement.

2. Digital Product License

All trading algorithms and software provided by The Next Tick Algo Systems are licensed, not sold.

  • Grant of License: We grant you a non-exclusive, non-transferable, and revocable license to use the software for personal, non-commercial trading purposes.
  • Restrictions: You may not reverse engineer, decompile, or disassemble the software to discover its underlying structure or source code.
  • No Resale: Sublicensing, leasing, or reselling the software or its signals to third parties is strictly prohibited.

3. High-Risk Warning and No Investment Advice

Trading financial instruments involves a substantial risk of loss.

  • No Advice: The Next Tick Algo Systems is a technology provider and does not act as an investment adviser, broker, or financial institution. All content, signals, and algorithms are for educational and informational purposes only and do not constitute personalized investment advice.
  • User Responsibility: You are solely responsible for all trading decisions and for configuring the software to match your risk tolerance. The Company does not execute trades on your behalf or monitor your personal brokerage accounts.
  • Performance: Past performance is not indicative of future results. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in backtests or testimonials.

Mathematical Risk Disclosure

The probability of a drawdown exceeding a specific threshold ($D$) based on a win rate ($q$) and stake size ($S$) can be modeled as:

Users acknowledge that while the software provides logic, market variables and execution risks remain entirely with the User.

4. Digital Delivery and Refund Policy

  • Instant Access: All products are delivered digitally. Upon completion of the purchase, access codes or download links are provided immediately.
  • Refund Policy: Due to the nature of digital products and their instant accessibility, all sales are final . No refunds, returns, or exchanges are offered once a download has commenced or access has been granted.
  • Waiver of Withdrawal: By purchasing and accessing the digital content immediately, you expressly consent to the commencement of performance and acknowledge that you lose any statutory 14-day right of withdrawal.1

5. Educational Courses

  • Service Description: Courses are provided “as-is” with reasonable care and skill. We do not guarantee any specific result, professional qualification, or financial gain from completing these courses.

6. Partnership (Affiliate) Program

Participants in our partnership program agree to the following:

  • Promotion Guidelines: Partners must not make false or misleading claims, such as “guaranteed profits” or “no-risk trading”.
  • Disclosures: Partners must clearly and conspicuously disclose their financial relationship with the Company in all promotional content (eg, using “#ad” or “#sponsored”).3
  • Commissions: Commissions are calculated based on qualified sales referred via unique affiliate links. Payments are made on a monthly basis provided the minimum payout threshold is met.
  • Termination: We reserve the right to terminate any Partner account for fraudulent activity, brand abuse, or violation of marketing standards.

7. Limitation of Liability

To the maximum extent permitted by law, The Next Tick Algo Systems shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to trading losses, lost profits, or system malfunctions. Our total liability for any claim shall not exceed the amount paid by the Client for the specific product or service in question.

8. Governing Law

These Terms shall be governed by and constructed in accordance with the laws of the jurisdiction in which the Company is headquartered, without regard to its conflict of law principles.
